Issuance of the Final Contract Year (CY) 2013 Medicare Marketing Guidelines (MMG)
For the CY 2013 MMG update, we conducted a comprehensive review with a focus on streamlining, consolidating, and removing outdated requirements. We released the draft MMG for public comment on February 16, 2012, and received approximately 1,775 comments. These came from 106 entities, including MAOs, PDP sponsors, consumer advocacy groups, pharmacy associations, health plan associations, and State departments of health. After careful analysis of all comments received, we have made a number of important revisions and clarifications to the final guidance.
Issuance of the Revised Draft CY 2014 Medicare Marketing Guidelines
For the draft CY 2014 update, we continued our streamlining efforts by eliminating duplication of information contained in other locations. This means that we removed some guidance from this chapter that could instead be included as instructions in model documents. We also made updates to include information about Health Plan Identification Numbers and the implementation of machine-readable technology requirements, and updates regarding responsibilities for contracted provider-based activities.
The draft 2014 Medicare Marketing Guidelines and the comment template are posted in the Download section below. We will carefully consider all comments before finalizing the Guidelines later this year. Please send your comments on the template no later than 5 PM (EDT), April 9, 2013 to Marketing@cms.hhs.gov with “Comments on Marketing Guidelines” in the subject line of the email.
CMS-State Collaboration Activities
The Centers for Medicare & Medicaid Services (CMS) as a part of our agreement to share information and collaborate on oversight issues with the State Departments of Insurance (DOIs), has strengthened protections for particularly vulnerable beneficiaries. CMS and participating State DOIs have signed a joint letter to educate and protect residents of low income senior and Independent Care for the Mentally Retarded and the Mentally Retarded and Developmentally Disabled (ICF/MR) housing facilities concerning inappropriate behavior of agents. In this letter, we urge facility administrators to be vigilant in reporting suspect Medicare Advantage and Prescription Drug plan marketing. We also describe Medicare and Medicaid patient rights and protections relative to agent behaviors as afforded under MIPPA. CMS continues to work collaboratively with the States where the sharing of information will not only strengthen State and Federal oversight efforts, but provide more protection for Medicare beneficiaries.
