This is a very positive step. I would strongly urge CMS to cover ANY HIV screening test ordered by a physician so that programs of 'opt out' screening would clearly be covered. If any limitation is placed on payment for HIV screening tests such as meeting at risk critieria or "voluntarily" requesting testing, the payment for screening and subsequently screening programs may be limited.

I agree with the proposal to expand coverage for HIV screening. I recommend that the wording be changed to "HIV screening with an FDA-approved test" as other technology for testing for HIV is coming available besides enzyme immunoassay (EIA), enzyme-linked immunosorbent assay (ELISA) or rapid HIV antibody test. By listing specific technologies can cause confusion in the testing community. My laboratory uses an immunometric assay that is FDA approved.

Aren''t we also concerned with people who had unprotected sex with one person 2 years ago and someone else now? The involved individuals may not perceive that as multiple partners. Payment for this test makes sense not only in the listed conditions, but in all sexually active people. Routine HIV testing has the potential for decreasing the incidence and spread of the HIV virus and should be encouraged in every setting. It is extremely imortant to increase HIV testing so that people know their status and are diagnosed early in the disease. The overwheling majority of people who are HIV positive takes steps to stop the transmission of HIV. Those diagnosed early can be treated and experience better health outcomes. Our organization is leading the Strategic Initiative for HIV/AIDS Care & Prevention in which we hope to end all new infections in 5 years. This will help in that effort.

As an emergency physician, I strongly support CMS reimbursement for HIV testing of Medicare and Medicaid patients. Medicaid patients especially are a vulnerable population group with decreased access to medical care in the inner cities. Having performed bedside HIV testing in our inner city emergency department over the past year, we have identified many HIV positive patients who did not know they were positive prior to testing. Many were early in the course of their HIV disease.

It is unduly restrictive to limit the definition to "HIV screening with an FDA-approved enzyme immunoassay (EIA), enzyme-linked immunosorbent assay (ELISA) or rapid HIV antibody test" when the definition should be expanded to include other licensed methodologies such as Chemiluminescence Immunoassay (ChIA) which are enzyme based however with more sensititive detection endpoints than colorimetric ELISAs/EIAs. The generally accepted definition of rapid is less than 60 minutes as well, which
