Comment:

I believe it is quite awkward to state "we do not believe that an NCD is possible or prudent at this time." If CMS has determined that an NCD is flatly "not possible", so stated by CMS, it is pointless and somewhat confusing to opine on whether an NCD is prudent. The additional phrase "or prudent", which adds no content if the action is impossible, simply leads the reader down a nonexistent path of thought.
