CMS makes certain data available to other government agencies as allowed by federal laws and regulations as well as CMS policy.
CMS has established the following pathways for government agencies to request CMS data:
- Research – Government agencies conducting research can request CMS data utilizing the standard research pathway.
For more information, please see Data Available to Researchers. - Health Oversight – Health oversight agencies can request CMS data for purposes of legally authorized health oversight activities.
- Law Enforcement - Law enforcement agencies can request CMS data with the appropriate order to support the request (e.g., subpoena, civil investigative demand).
- Required by Law - Government agencies can request CMS data as required by federal statute, regulation, or court/administrative orders.
Disclosures of CMS controlled unclassified information to government agencies for purposes other than research may require specialized agreements. Government agencies requesting controlled unclassified information for purposes other than research can direct questions to DataUseAgreement@cms.hhs.gov.
