The proposed regulation went on display at the Office of the Federal Register's Public Inspection Desk on July 1, 2009, and was published on July 13, 2009. See CMS-1413-P in the "Related Links Outside CMS" section below.
Medicare is statutorily required to review, and if necessary, adjust the malpractice relative value units (RVUs) no less than every 5 years. In the calendar year (CY) 2010 physician fee schedule (PFS) proposed rule, we have made revisions to the malpractice RVUs for CY 2010 based on an updated and expanded malpractice premium data collection.
The interim report on Malpractice RVUs for the CY 2010 Medicare PFS proposed rule and Malpractice premium amounts and risk factors by specialty, which was produced by Acumen, LLC under contract to CMS, is found in the Downloads section below.
