Whether the Intermediary's removal of residents who participated in Colorectal Surgery (fiscal years ("FYs") 2002-2006), Internal Medicient (FYs 2004-2006), and Neurology (FYs 2004-2006) programs (collectively, "Programs") from the Provider's Graduate Medical Education ("GME") and Indirect Medical Education ("IME") full-time equivalent ("FTE") counts on the basis that these programs did not qualify as "new programs" under 42 C.F.R.
