e-Rulemaking
On January 15, 2008, in accordance with the President's eRulemaking Initiative (see link under "Related Links Outside CMS"), we began migrating CMS regulations to the Federal Dockets Management System (FDMS) at Regulations.gov. As a result of our migration, we began accepting electronic public comments through FDMS via Regulations.gov. The process for submitting regulatory comments via mail or courier remains unchanged. CMS continues to accept regulatory comments via mail or courier.
This page provides instructions for viewing documents open for public comment, submitting public comments, and reviewing public comments received on regulations.
Generating a List of, or Submitting Electronic Comments on, CMS Regulations
To generate a list of the Federal Register (FR) documents posted today and open for public comment:
- Go to regulations.gov (See link under "Related Links Outside CMS")
- Click Go under More Search Options
- Under Find and Take Action, click on Go under Documents published today and open for public comment.
- Click on CMS in the left hand corner.
- A list of Federal Register documents will be displayed.
To submit electronic comments on Federal Register (FR) documents published or migrated as of January 15, 2008.
- Go to regulations.gov (See link under "Related Links Outside CMS")
- Click Go under More Search Options
- Click on your preference under Find and Take Action
- Check out "User Tips" for submitting Electronic Comments at regulations.gov.

- Go to regulations.gov. (See link under "Related Links Outside CMS")
- Go to the Comment or Submission tab.
- Enter the CMS file code or keywords related to the document.
- Click Go.
- A list of Federal Register documents will be displayed.
Reviewing Comments on CMS Regulations
To review the comments we have received on regulations with comment periods ending on or after January 1, 2008, please use the Regulations.gov link under "Related Links Outside CMS" and follow the search instructions above.
To review the public comments received on CMS regulations with comment periods beginning February 2004 and ending on or before December 31, 2007, please refer to the "Electronic Comments on CMS Regulations" link on the left navigation bar.
